Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Enrichabl website, applications, and APIs (collectively, the "Service") operated by Enrichabl ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By accessing the Service you confirm that you are at least 18 years old, that you have the authority to enter into these Terms (including on behalf of your organization, if applicable), and that your use of the Service will comply with all applicable laws.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@enrichabl.com if you suspect unauthorized access.

3. BYOK Responsibility

Enrichabl operates on a Bring-Your-Own-Key (BYOK) model. When you connect third-party data providers, you acknowledge and agree that:

• You own and are solely responsible for the API keys you connect.
• You are responsible for the costs, terms, and compliance obligations associated with each provider you use.
• Enrichabl is not a party to your relationship with any third-party data provider and is not liable for the accuracy, availability, or licensing of data returned by those providers.
• You are responsible for ensuring you have a lawful basis to enrich, store, and use any contact data you process through the Service.

4. Acceptable Use

You agree not to use the Service to:

• Violate any law, regulation, or third-party right.
• Send unsolicited bulk communications (spam) or otherwise misuse contact data in violation of applicable anti-spam, telemarketing, or privacy laws (including GDPR, CCPA, CAN-SPAM, and CASL).
• Reverse engineer, decompile, or attempt to derive the source code of the Service.
• Resell or sublicense the Service without our written consent.
• Interfere with the Service's operation, attempt to gain unauthorized access, or circumvent rate limits or security controls.
• Upload data containing malware, illegal content, or sensitive personal data categories that the Service is not designed to process.

5. Payment and Billing

Paid plans are billed in advance on a monthly or annual basis through our payment processor, Stripe. Fees are non-refundable except as required by law or as expressly stated in our refund policy below. You authorize us to charge your payment method on file for all applicable fees, including renewals. Provider costs incurred under your BYOK keys are billed to you directly by those providers and are not part of Enrichabl's fees.

6. Refunds

We offer a 14-day refund window for first-time paid subscriptions if the Service does not meet your needs. Beyond that window, paid subscriptions are non-refundable. To request a refund, email support@enrichabl.com.

7. Intellectual Property

The Service, including all software, text, graphics, and trademarks, is owned by Enrichabl and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

You retain all rights to the data you upload ("Customer Data"). You grant us a limited license to process Customer Data solely to provide and improve the Service.

8. Service Availability

We strive to keep the Service available and reliable, but we do not provide a formal uptime SLA on free tier accounts. Paid plans may include availability commitments as described on the relevant plan page. The Service is provided on an "as is" and "as available" basis, and we may perform scheduled maintenance from time to time.

9. Termination

You may terminate your account at any time from your account settings. We may suspend or terminate your access to the Service if you breach these Terms, fail to pay fees owed, or use the Service in a way that exposes us or other users to legal or security risk. Upon termination, your right to use the Service ceases immediately and your data will be handled in accordance with our Privacy Policy.

10. Limitation of Liability

To the maximum extent permitted by law, Enrichabl and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of the Service. Our aggregate liability for any claim arising under these Terms is limited to the greater of (a) the amount you paid us for the Service in the twelve months preceding the claim, or (b) one hundred US dollars (US$100).

11. Indemnification

You agree to indemnify and hold Enrichabl harmless from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, your violation of any third-party rights, or your processing of Customer Data through the Service.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles. Any dispute arising under these Terms will be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will revise the "Last updated" date and, where appropriate, notify you by email or in-product notice. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
